Introduction

Alexandra Kiely and A Scholarly Skater Art History (“I”, “my”, “we”, “us”, “our”) publish a website (“A Scholarly Skater”, “this website”) with articles, posts, courses, and downloadable content designed to empower users to approach historical art and architecture with confidence.

These Terms of Service (“Terms”) describe our commitments to you, and your rights and responsibilities when using our services. They govern your access to and use of the content, including posts, articles, courses, and downloadables (our “Services” or “Products”). Please read these Terms carefully before accessing or using our Services. By accessing or using any part of our Services, you agree to be bound by all of the Terms and all other operating rules, policies, and procedures that we may publish via the Services from time to time (collectively, the “Agreement”). You also agree that we may automatically change, update, or add on to our Services as stated in the Terms, and the Agreement will apply to any changes.

Who’s Who

“You” means any individual or entity using our Services. If you use our Services on behalf of another person or entity, you represent and warrant that you’re authorized to accept the Agreement on that person’s or entity’s behalf, that by using our Services you’re accepting the Agreement on behalf of that person or entity, and that if you, or that person or entity, violates the Agreement, you and that person or entity agree to be responsible to us.

Minimum Age Requirements

A Scholarly Skater Art History is intended for users aged 18 or older. If you visit the site or use any of its content and products, you represent that you are at least 18 years old. Younger viewers may only use our website and products with the permission and supervision of a parent or guardian. In that situation, said parents or guardians must agree to these terms and condition.

Your Account

When using our Services requires an account or subscription, you agree to provide us with complete and accurate information and to keep the information current so that we can communicate with you as necessary.

You’re solely responsible and liable for all activity under your account. You’re also fully responsible for maintaining the security of your account (which includes keeping your password secure). We’re not liable for any acts or omissions by you, including any damages of any kind incurred as a result of your acts or omissions.

Fees

Some of our Products are offered for a fee, like certain online courses and downloadable handbooks (“Paid Products”). This section applies to any purchases of Paid Products. By purchasing a Paid Product, you agree to pay the specified fees.

We reserve the right to set, raise, and lower prices as we see fit and to provide discounts and coupons as we see fit. We reserve the right to start charging for content that was previously free and to release for free (either temporarily or permanently, in part or in full) content that was previously paid. Since our Paid Products are sold via one-time fees, existing customers will not be charged an additional balance if we raise prices on products they’ve already purchased, nor will they receive credits or refunds if we lower or eliminate prices on products they’ve already purchased.

Your purchase of a course or handbook is valid for one user only.

Taxes

To the extent permitted by law, or unless explicitly stated otherwise, all fees do not include applicable federal, provincial, state, local or other governmental sales, value-added, goods and services, harmonized or other taxes, fees, or charges (“Taxes”). You’re responsible for paying all applicable Taxes relating to your use of our Services, your payments, or your purchases. If we’re obligated to pay or collect Taxes on the fees you’ve paid or will pay, you’re responsible for those Taxes, and we may collect payment from you.

Payment

Starting September 3, 2024, all payments for Paid Products will be handled through Etsy. Please see Etsy’s privacy policy and terms of use, which will apply to these transactions, along with my Etsy-specific privacy policy accessible through my shop.

Refunds

In accordance with Etsy’s policies for the sale of digital products, all sales are final unless otherwise required by law. However, I want my customers to be happy. If you are not satisfied with your purchase, please let me know and I’ll see if there’s anything I can do.

Changes to Content

We always strive to provide the best possible content to our users. This sometimes means modifying or even removing content. To that end, we reserve the right to make changes in, additions to, or subtractions from published content – including Paid Products – however and whenever we see fit, without notification or explanation. There will be no refunds or credits of any kind if we remove content from Paid Products.

However, we do not promise or guarantee to revise, improve upon, add to, or update content.

Comments

Some pages and posts include places for users to submit comments and occasionally other content (“Comments”). By submitting, you are giving us permission to display your submission on our website, along with the name or username you provide.

Your Comments may not violate anyone’s intellectual property rights (for example, don’t post quotations from published writings and pass them off as your own). You may not share anyone’s private personal information, use the Comments to conduct illegal acts, or include links to malicious content (such as spyware). Doing so will result in being blocked from posting Comments in the future. Repeated instances of Comments that harass or threaten anyone may also result in being blocked. Since Comments are displayed publicly, take care in deciding what to share in them.

All Comments sections and other areas for user-submitted content are moderated. We reserve the right to remove, or not publish in the first place, any comment or other content for whatever reasons we see fit, without notice or explanation. These may include, but are not limited to, spam content, obscene language, illegal content, inappropriate or harassing content, questionable links, or a lack of relevance to the topic at hand. The intention is not to censor anyone but rather to maintain a positive and welcoming environment where everyone can talk about art without unnecessary conflict.

If you ever change your mind about content you submitted to our website, let us know and we’ll remove it. Of course, we cannot know or control whether someone else has already saved it (such as by printing or screen-shotting the page). If your Comment involved feedback, ideas, or suggestions for us, we still have the right to use them even once your comment has been removed.

We moderate each submission before approval to prevent inappropriate Comments from appearing on the website. However, no system is completely foolproof. If inappropriate content ever does slip past us, we will make every effort to remove it as expediently as possible and hold no responsibility whatsoever for its appearance or the consequences of it.

User-submitted content does not necessarily reflect the opinions of Alexandra Kiely or A Scholarly Skater Art History, and the appearance of a Comment on our website should not be taken as agreement with or endorsement of the views expressed within it.

When your Comments or other user-submitted content convey ideas or feedback to us – like if you suggest an idea for a new post or ask a question about an article’s content – you agree that we’re free to use them without any restriction, compensation, or acknowledgement to you.

US Economic Sanctions

Translation

These Terms were originally written in English (US). We may translate these terms into other languages, and in the event of a conflict between a translated version of these Terms and the English version, the English version will control.

Miscellaneous

The Agreement (together with any other terms we provide that apply to any specific Service) constitutes the entire agreement between A Scholarly Skater Art History and you concerning our Services. If any part of the Agreement is unlawful, void, or unenforceable, that part is severable from the Agreement, and does not affect the validity or enforceability of the rest of the Agreement.
